Privacy & Personal Information Protection Policy

LivCity is committed to safeguarding the personal information entrusted to us by our clients. We are committed to transparency in the collection, use and disclosure of your personal information. We manage your personal information in accordance with Alberta’s Personal Information Protection Act and other applicable laws related to privacy in Alberta, Canada and other jurisdictions in which we operate. This Policy outlines the principles and practices we follow in protecting your personal information. The Policy also applies to any person providing services on our behalf. A copy of this Policy is provided to any client on request and is also available on our website located at: livcity.ca.

This Policy describes how we use personal information and the circumstances under which we may share this information with a third party. This Policy applies to the LivCity website and applications (collectively, “LivCity Resources”), but does not include personal information relating to employees in such a capacity.

By visiting and or using the LivCity Resources, you consent to the collection, use, storage, disclosure and transfer of your personal information as set out in this Policy. If you do not agree with any part of this Policy, you should not use any of the LivCity Resources, navigate away from the LivCity Resources immediately and uninstall any of our applications.

What is personal information?

Personal information means information about an identifiable individual. This includes an individual’s name, home address and phone number, age, sex, marital or family status, an identifying number, financial information, educational history, etc.

What personal information do we collect?

We collect only the personal information that we need for the purposes of providing services to our clients, including personal information needed to:

  • Create an account;
  • Interact with the LivCity Resources to:
    • Check in and view where your personal contacts have checked in (Social Media Function);
    • Check coupons, specials, order history, dietary preferences, location and device information for supplying goods and services (Consumer Function); and
    • Pay for goods and services (Purchase Function).

Such information includes your:

  • Name;
  • Cell phone number;
  • Email address;
  • Password of your selection;
  • Pin number of your selection;
  • Age; and
  • Dietary preferences and allergies.

You will need to enter this Personal Information when requested in order to access and use LivCity Resources.

We may automatically collect other personal information when you use the LivCity Resources. LivCity and its third-party service providers, collect, process, store and analyze information obtained from your browser or device when you use LivCity Resources, including IP address, your location when the LivCity application is used, device identifiers, browser characteristics, operating system details, language preferences, referring URLs, length of visits and pages viewed.  We may also use “cookies” (a tiny element of data that allows LivCity Resources to recognize you when you return to LivCity Resources at a later date), or other tools that track, measure and analyse the behaviours and usage patterns of clients and potential clients of LivCity.  We use this information to help us understand how visitors use LivCity Resources and to help us improve LivCity Resources. Cookies are commonly used by service providers, but you can also set your web browser or smartphone to notify you when you receive cookies and to not accept certain cookies.  Should you choose not to accept cookies from LivCity, some of the features of the LivCity Resources may not be available to you.

Some third-party service providers may use cookies on our site, so we want to let you know that we do not control these cookies and they are not covered by this Policy.

Consent

We ask for consent to collect, use or disclose client personal information, except in specific circumstances where collection, use or disclosure without consent is authorized or required by law. We may assume your consent in cases where you volunteer information for an obvious purpose.

We ask for your express consent for some purposes and may not be able to provide certain services if you are unwilling to provide consent to the collection, use or disclosure of certain personal information. Where express consent is needed, we will normally ask clients to provide their consent in writing (by signing a consent form, by checking a box on a form, or electronically by clicking a button). In cases that do not involve sensitive personal information, we may rely on “opt-out” consent. For example, we may disclose your contact information to other organizations that we believe may be of interest to you, unless you request that we do not disclose your information. You can do this by sending us an email at privacy@livcity.ca stating your intention to opt-out of all personal information disclosure at any time.

A client may withdraw consent to the use and disclosure of personal information at any time, unless the personal information is necessary for us to fulfil our legal obligations. We will respect your decision, but we may not be able to provide you with certain products and services if we do not have the necessary personal information. We may collect, use or disclose client personal information without consent only as authorized by law. For example, we may not request consent when the collection, use or disclosure is reasonable for an investigation or legal proceeding, to collect a debt owed to our organization, in an emergency that threatens life, health or safety, or when the personal information is from a public telephone directory.

Collecting, Using and Disclosing Your Personal Information

We use and disclose client personal information only for the purposes for which the information was collected, except as authorized by law. For example, we may use client contact information to permit the pre-payment for food and beverages. The law also allows us to use that contact information for the purpose of collecting a debt owed to our organization, should that be necessary. If we wish to use or disclose your personal information for any new business purpose, we will ask for your consent.

Account Creation

We collect personal information when you create your account on LivCity Resources. We use this information to administer your account, to enable your access to the LivCity Resources, verify your identity as an authorized user, and to implement, carry out and maintain security measures aimed at protecting our customers from identity theft, fraud and unauthorized access to an account. We use this information to administer your account, and to enable your access to the LivCity Resources. At any time, you can choose to delete your LivCity account and we will not use or disclose your personal information after that time, except as permitted by this Policy.

Social Media Function

Clients may choose to allow others to see where they have checked in.  We collect and use information relating to your Check-in at locations, in order to allow contacts to see where you have checked in, as applicable with the permissions you set. Clients may also choose to allow LivCity Resources to access their contacts in order to receive updates as to where their contacts have checked in, if those contacts have also agreed to share their check in information.

We may offer you the opportunity to otherwise engage with LivCity Resources or its content on or through Social Media. When you engage with us through Social Media websites, plug-ins and applications, you may allow us to have access to and disclose certain information associated with your Social Media account (e.g., name, username, email address, profile picture) to deliver content or as part of the operation of the website, plug-in or application.

From time to time, LivCity may offer you the opportunity to further participate by taking part in one of our surveys or other customer research, or to provide further feedback about LivCity.  The information obtained through our surveys and research is used in an aggregated, non-personally identifiable form to help us understand our clients and to enhance our service offerings.

Consumer Functions

We collect information relating to any Consumer Functions, such as which coupons you choose to save for future use, so they may be accessed by you later. We also collect and use your check-in information to allow you to access the menus and place orders.

We may collect your order history including the date, time, cost and order details, including specific food items ordered and special order instructions. We use this information to ensure that your order has been completed and to improve our service offerings.

We may use your personal information to contact you for your opinion regarding LivCity and LivCity Resources and to notify you occasionally about important changes or developments to the LivCity Resources. You cannot opt out of receiving notifications of important changes or developments (e.g., to this Policy or the Terms of Service) unless you discontinue use of the LivCity Resources.

You agree that we may use your personal information to let you know about events, products and services that may be of interest to you, including services that may be the subject of direct marketing. We may contact you to do so by telephone, text messaging or email, or via push notification on our mobile application.  It is always your choice whether to receive or to continue receiving such marketing materials (“Marketing Communications”).  If you no longer wish to receive the Marketing Communications, you can opt-out by emailing us at privacy@livcity.ca, or by changing the push notification permission in the LivCity Resources.

Pay Function

We collect information relating to any orders you place and gift cards you purchase using the LivCity Resources, including the IP address of the device used to place the order to help protect against theft, fraud and unauthorized access to an account, and payment information (e.g. your credit card number) using the secure services of our payment processors. Payment operations are outsourced to our payment processors and we do not store your credit card information in our systems.

How do we safeguard personal information?

We make every reasonable effort to ensure that client information is accurate and complete. We rely on our clients to notify us if there is a change to their personal information that may affect their relationship with LivCity. If you are aware of an error in our information about you, please let us know in writing and we will correct it on request wherever possible.

We protect client personal information in a manner appropriate for the sensitivity of the information. We make every reasonable effort to prevent any loss, misuse, disclosure or modification of personal information, as well as any unauthorized access to personal information. We have implemented administrative, technical and physical measures to protect your personal information from unauthorised access and against unlawful processing, accidental loss, destruction and damage. We restrict access to your personal information to LivCity personnel and authorized service providers who require access to fulfill their job requirements.

The Personal Information you provide to LivCity will be held on the servers we use, which are located in North America.  Our LivCity staff all work within Canada, but your personal information may be accessed by third parties as described above, which may mean that your personal information is sent outside of Canada for processing and storage. While your personal information is outside of Canada, it is subject to the laws of the country in which it is held.

The third parties with whom we share your information may undertake various activities such as processing credit card payments and providing services or products for us. In addition, we may need to provide your personal information to any venues that a customer has placed an order with to allow your order to be processed. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this Policy.

We will retain your information where we have an ongoing legitimate business need to do so (for example, while you hold an account with us and for a reasonable period of time thereafter, or to enable us to meet our legal, tax or accounting obligations). We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personal information, or account recovery, or if required or permitted by law. All retained personal information will remain subject to the terms of this Privacy Policy. If you request that your name be removed from our databases, it may not be possible to completely delete all your personal information due to technological and legal constraints.

We render client personal information non-identifying, or destroy records containing personal information once the information is no longer needed. We use appropriate security measures when destroying client personal information, including shredding paper records and permanently deleting electronic records.

The transmission of information via the internet is not completely secure. Although we will take steps to protect your personal information, we cannot guarantee the security of your personal information or other data transmitted to LivCity; any transmission is at your own risk. Once we have received your personal information, we will use organizational and technical safeguards to try to prevent unauthorised access. Please also note that LivCity Resources contain links to third party websites, which are not governed by this Privacy Policy, and LivCity is not responsible for the collection, use or disclosure of Personal Information by such third party websites. When you click on such a link, you will leave our service and go to another site. During this process, another entity may collect personal information from you.

We will notify the Office of the Information and Privacy Commissioner of Alberta, without delay, of a security breach affecting personal information if it creates a real risk of significant harm to individuals.

Access to records containing personal information

Clients of LivCity have a right of access to their own personal information in a record that is in our custody or under our control, subject to some exceptions. For example, organizations are required under the Personal Information Protection Act to refuse to provide access to information that would reveal personal information about another individual. Organizations are authorized under the Act to refuse access to personal information if disclosure would reveal confidential business information. Access may also be refused if the information is privileged or contained in mediation records. If we refuse a request in whole or in part, we will provide the reasons for the refusal. In some cases where exceptions to access apply, we may withhold that information and provide you with the remainder of the record.

You may make a request for access to your personal information by writing to our Privacy Officer, at privacy@livcity.ca.  You must provide sufficient information in your request to allow us to identify the information you are seeking. You may also request information about our use of your personal information and any disclosure of that information to persons outside our organization. You may also request a correction of an error or omission in your personal information. We will respond to your request within 45 calendar days, unless an extension is granted. We may charge a reasonable fee to provide information, but not to make a correction. We will advise you of any fees that may apply before beginning to process your request.
